This power ought to specify which roll determines the hit.
I'd suggest adding to the first and second sentences:
"Make the attack roll twice, using the higher result. If the lower result would also have hit, ...'
This clarifies which attack roll is used to determine the hit, and makes it clear what happens on a crit on one attack roll, but not the other (the damage is maximised, including the extra damage from the second roll if it hit.)

Also, RAW it doesn't explicitly behave like an Avenger attacking his Oath target, but rather like a Scout's Dual Weapon attack, since the line about using the higher result isn't added. The current effect doesn't fit the flavor of making a single attack more powerful.
