I'm also curious what changes you'd make post Dark Sun/Essentials... largely in part because I'll be playing a Genasi Taclord in an upcoming campaign, and my build took some significant inspiration from this one.
One thing I did different in my build was take proficiency with Spiked Shield instead of Heavy Shields. A Spiked Shield enchanted as a Rhythm Blade offers the same shield bonus and has the same feat cost as going with a Heavy Shield. It then becomes a trade-off of paying for the enchantment for the Spiked Shield, or suffering the -2 check penalty for the Heavy Shield. I'd rather pay for an enchantment than lose -2 points on Athletics and Endurance, especially at higher levels with more gold.
I also fit permafrost into my build as well, but I was able to do that due to house-rules for expertise and NAD-boosting feats.

I've actually made some small changes in the build, but they have more to do with feat order than they do with the feats themselves. I like my current lineup a lot, and it has served me quite well. I would like to have Lashing Flail, but it would have to compete against the myriad array of feats I already have in Paragon, and that's a tough rotation to crack.
On the subject of changes, I also made a new sketch for the build. Let me know what you think!

The picture is cool - more of a roguish flavour to it than the last one.
I've noticed in your changes to the build, intuitive strike is back in the build at 1st level. It then changes over to inevitable wave at level 11. Is this intended?

Thanks for the catch - it's supposed to be replaced throughout. Inevitable Wave has been rather spotty in my playtests, even when used alongside dedicated chargers.

I'm wondering what would be a good 1st level feat if your DM doesn't let you take Mark of Healing? I'm not sure if many DM's would anyway unless you were playing in Eberron, since the Dragonmarks are pretty world-specific.
I'm thinking either a proficiency in bastard sword or a feat that also can grant saving throws to others, though I'm not savvy enough to know what they are.

Bastard Sword, as erachima is wont to remind us, is never worth it. Go with Saving Inspiration IMO, especially if you're the only leader in the party.

Short version: a feat for a +1 damage.
There are feats that give you better weapons, and there are feats that give you more damage; aside of the whole thing that maybe damage shouldn't be your first priority as a leader.

I personally favor the feat "skill power" over "toughness". Skill power can give you the lvl10 utility "Reactive surge". Which is in a lot of cases more HP than the "toughness" feat can give you. With Skill power you just wait for the next big life gain utility power and switch it.
