Actually, there is no "only" in the equation. A dungeon master can do whatever the hell he wants, when he wants. The only caveat is that it is best that the players see the DM as impartial.

By playing an unaligned character as evil, said player is making the game more difficult and less satisfying for all involved. You are allowed any and all measures to rectify this. But of course you're trying to lose the character, not the player.

Pretty much. Just cos player hasn't chosen alignment, doesn't mean behaviour is irrelavent. DM could fairly say "your character is acting in a way consistent with having chosen evil alignment. Thus, your character has chosen, even if you haven't.

If you don't want to go this way: maybe talk with player about what counts as too evil for an unaligned chracter to be willing to do on a regular basis.

The old stand by of let the players reap what they sow never fails...

If that character is over the top in his fiendish-ness, have the character get punished. Cause and effect is a perfectly valid way of dealing with it if the character doesn't understand what's wrong with killing like crazy.

I wholeheartedly agree with every single person on this board who says that these players should reap what they sow. All unaligned means is that you haven't devoted yourself to the cause of good or evil-one can be a murderous psychopath and still not be devoted to evil for evil's sake. But what's important when dealing with mercenary or dark PC's (so long as their actions are in keeping with their character's personalities) is to note the consequences of their actions.

If the players have a tendency to rob and murder ask yourself these questions. Are there any survivors?

Have these survivors told anyone?

Have the proper authorities assembled some sort of file on the characters?

Do criminal organizations start contacting the characters, either to recruit them or to put down the loose cannons operating in their area?

Have their actions come to the attention of good-aligned churces and if so, have sworn knights/clerics made it their quest to end the character's evil?

If yes to the above question, will the knights/clerics in question want to imprison, try at court, or just flat out kill the characters?

Have these character's actions opened up an avenue for a real villain who threatens both the surrounding area and the characters?
