It was not in the contract. RPGNow rep said as much. Ignore it if you want, but that doesn't change the fact that Steve clearly said it was not intended as a guarantee and that they messed up (by not stating that clearly enough).

"Not in the contract" is not the same as "disallowed in the contract". Again, read what I said. Legal Gray Area.

Morally, take whatever side you want.

The grace period includes redownloads, so it's all but apparent that it's definitely not disallowed in the contract. Otherwise, any attempt by WoTC to charge the distributors for breach of contract would be thrown out the window.

Not so. WoTC could have allowed them to re-download after the fact, even if it was disallowed in the original contract.

You cannot tell a company to continue breaching a contract, and then turn around later and sue them for breaching the said contract.

I never said this.

Because every person has the right to not sell their property. A global pullback is essentially exercising your right to withhold selling your property to everyone.

And you can sign away your rights.

Read your bill of rights for crying out loud.

I work in a field where people sign away their right to a trial all the time.

Yes, to some extent. I think we both know that there are some rights that the law won't let you sign away. That's one more reason in a dicey situation to get a good lawyer that works for you. A lawyer knows what rights you signed away and which you only thought you could.

Sorry for the digression.

In other news I don't think I can think of a thread that has hit 2600+ replies in a few days or maybe a week.

WoTC. Customer satisfaction guranteed. Adds this move to the DDI turkey.
Reducing a character to a list of dice rolls and modifiers is not role playing*

Same thing. If you sign a new contract allowing redownloads, then you effectively nullified your previous contract that disallowed redownloads.

It's a gray area. Not disallowed, but not outright stated as allowed.

I never said this.

Re-clarify.

And you can sign away your rights.

This is one of those that you can't :P.

You can't sign away your right to a trial. Even an out-of-court settlement or plea bargain is still technically a trial in a legal sense (it's just not a public trial, but it's still ultimately presided by a judge).

You can, however, sign away your right to a defense :P.

Not all rights can be signed away or sold. Your right to refuse the sale of your property is one of them, at least until you decide to sell the said stuff :P.

It is NOT the same thing. It is a different NEW thing.

You need to look up what "gray area" means. Something spelled out in a contract is NOT a gray area.

Re-clarify.

I'm not sure what you want me to re-clarify. I never said anything even close to that comment.

This is one of those that you can't :P.

Heh. All I have is your word on that. Can you provide a link to Federal Law confirming that?

You can't sign away your right to a trial. Even an out-of-court settlement or plea bargain is still technically a trial in a legal sense (it's just not a public trial, but it's still ultimately presided by a judge

Yes you can. I work in Employment Law and people sign away their rights to a civil trial all the time. That's what Binding Arbitration is.

Not all rights can be signed away or sold. Your right to refuse the sale of your property is one of them, at least until you decide to sell the said stuff :P.

Again. I'd like to see the link to that. I'm not saying your wrong, I'm just not willing to concede the point based on your say so.

After my first post to this thread I noticed that between the start and end of what I had to say at least 5 people had made posts, and the pattern continued. I compared it to the "new edition" threads when 4E was announced. If people are this upset WotC might want to rethink their plans. I guess they beleive it(this thread) will go away eventually. It might, but customers might leave with it.

Well, if enough people get disgusted and don't play or use Wotc's games anymore, then the piracy problem has been pretty much licked, no? :P

One could even argue piracy actually helps WoTC sales. Who wants to use crappy scanned PDFs to run a game? A scanned book is still useful to give you an idea if you want to buy a book or not. I always buy dead tree format books which is hard here with no gamestore. Amazon is my freind and hopefull several SW Saga books will arrive this week.
